NLRB Regional Director Agrees with 1199SEIU Employees At Four Sites Should Vote In Election

The Boston-based Regional Director of National Labor Relations Board has ruled that employees represented by 1199SEIU United Health Care Workers East should vote in an upcoming election about representation. Attorney David Rome represented the Union in this proceeding.

Several years ago, the Employer and the Union negotiated a five-year contract that expressly agreed that employees at four different facilities were in a single bargaining unit. The contract provided different rates and dues obligations to employees based on their facilities. Nonetheless, the Regional Director ruled that the future of collective bargaining at the facilities must be decided by a majority of interested employees at all locations and cannot be decided on a location-by-location basis.
