Federal Appeals Court In Boston Rejects Right-Wing Challenge to Union's Right to Represent Daycare Workers

In a unanimous opinion authored by retired U.S. Supreme Court Justice David Souter, a panel of the First Circuit Court of Appeals has dismissed a complaint led by an anti-union group against the right of daycare workers to be represented by SEIU Local 509. The Koch-funded National Right to Work Legal Defense Foundation, which exists to diminish the collective strength of workers, asserted that it was unconstitutional to recognize the vote of a majority of day care workers to determine their wages and benefits through collective bargaining. Justice Souter and two other appellate court judges rejected this argument, just as the District Court judge did earlier.
